JUSTICE SUDHIR SINGH ORAL ORDER 30-04-2015 The petitioner is apprehending his arrest in connection with Itarhi P.S.Case No. 5 of 2014 instituted under Sections 166,167, 420, 467, 471, 472, 474 and 34 of the Indian Penal Code. Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that the complainant filed a complain case stating therein that he came to know that the petitioner has purchased the land in Khata No. 3 in Mouza Odhi. Her father came to know that the petitioner made a forged paper for garbing the land of the complainant. It is further stated that the petitioner made mutation of Khata No. 48, Plot no. 32, Area 33 decimals in the year 2013-14. It is further alleged that the accused persons made cutting of plot no.33 and made 32. He further alleged that other plots made mutation before a long time.

Patna High Court Cr.Misc. No.49719 of 2014 (2) dt.30-04-2015 2/2 It is submitted on behalf of the petitioner that the petitioner has no criminal antecedent. It is further submitted that the petitioner is a bona fide purchaser of the land, in question, by virtue of a sale deed and in terms of the sale deed a mutation was also made in his favour. It is further submitted that the sale deed is of the year 1972 i.e. after 40 years the present case has been filed.

It is submitted on behalf of the State that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar, in connection with Itarhi P.S.Cas No. 5 of 2014 arising out of Complaint Case No. 1402 of 2013 , subject to the conditions as laid down u/s 438(2) Cr.P.C.
