JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-03-2015 The application with regard to petitioner no.1 has already been permitted to withdraw vide order dated 06.02.2015. Heard learned counsels for the petitioner and the State. Petitioner no.2 Santosh Kumar Singh is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.

The accusation is of assaulting the informant, informant's daughter and Sarju Singh and taking away rupees twenty five thousand. The motive for committing the offence is alleged to be land dispute and distribution of land acquisition compensation. It is submitted by learned counsel for the petitioner that though the injury appears to be simple but the opinion has reserved. There is counter version of the occurrence and the petitioner has also received injury. The accusation of assault is general and omnibus and co-accused Lal Mohan Singh has already been granted anticipatory bail by this Court vide Criminal Miscellaneous No.50106 of 2014. Considering the aforesaid facts, let petitioner no.2 Santosh Kumar Singh be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Baroon P.S.
