The petitioner Chhangura Devi apprehends her arrest in Bhabhua P.S. Case No. 298 of 2014, registered for the offences punishable under Sections 366A and other Sections of the Indian Penal Code.

The allegation is that the petitioner and others kidnapped the married daughter of the informant for going along with co-accused Gorakh Ram.

Learned counsel for the petitioner submits that the victim girl disclosed in her statement made under Section 164 of the Cr.P.C. that this petitioner only asked the victim to go along with Gorakh Ram, but the petitioner did not use any force or took the victim to any other place.

Learned APP did not dispute the facts.

Patna High Court Cr.Misc. No.51894 of 2014 (2) dt.06-01-2015 It appears that the victim is a married lady and the petitioner did not use any force and the petitioner asked the victim to go along with Gorakh Ram and thereafter the victim herself accompanied Gorakh Ram to different places.

Considering the facts aforesaid and nature of allegation made against the petitioner, she above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabhua in connection with Bhabhua P.S. Case No. 298 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
