Learned counsel appearing on behalf of the petitioner seeks to withdraw the present writ petition with a liberty to avail the remedy before the appropriate authority to reconsider the impugned order of the penalty contained in Memo No.5601 dated 31.12.2008, which has been passed ex parte against the petitioner.

3. Considering the aforesaid submissions made on behalf of the petitioner, the petitioner may approach the
