The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 379/34 of the Indian Penal Code. The prosecution case is that on 08.01.2016 at 1.00 P.M. government land was measured by the Amin when the petitioner along with co-accused Yashwant Singh and Dhananjay Singh obstructed the measurement when the informant' brother Mukesh Kumar made protest then this petitioner assaulted with Bhujali to Mukesh causing injury on the head and left eye. When the informant went to rescue his brother Yashwant Singh assaulted with sword and Dhananjay Singh assaulted with Bhujali to the informant.

No.15238 of 2016 (2) dt.12-04-2016 2/2 It is submitted by learned counsel for the petitioner that the petitioner is retired Army Personnel aged about 75 years and for the occurrence of 08.01.2016 at 1.00 P.M. the FIR was registered on 09.01.2016 at 10.00 P.M. when the injury report reflects that the injured Mukesh has received three injuries caused by sharp cutting weapon and co-accused have been granted bail by the learned court below. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the nature of injury, it is a case for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Awatar Nagar P.S. Case No. 10 of 2016 pending in the court of learned Chief Judicial Magistrate, Saran at Chapra.
