JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-09-2019 Learned counsel for the petitioner submits that the petitioner has applied for a fresh electric connection with the South Bihar Power Distribution Company Ltd. but the same is not being considered.

Learned counsel has relied upon the judgment of the Hon'ble Division Bench passed in L.P.A. No. 1139 of 2012 as contained in Annexure '7' to the writ application to submit that

Patna High Court CWJC No.16547 of 2019(2) dt.11-09-2019 2/2 in similar circumstance the Hon'ble Division Bench had been pleased to take a view that if the appellant makes an application for fresh connection and complete the formalities, he should be granted fresh electric connection in the concerned premises. A prayer has been made to dispose off the writ application in similar terms.

In the given facts and circumstances of the case, at this stage, this Court disposing off this writ application with a direction to respondent no. '3' to look into the grievance of the petitioner and consider the request for fresh electric connection within a period of three months in the light of legal propositions taking into account the facts of the case and after hearing all the stake holders/Respondent(s).
