Perused the order dated 08.01.2016 passed by learned Subordinate Judge-III, Darbhanga in Title Suit No.95 of 2011 whereby the court below has allowed the intervention application filed by respondent nos.6 to 10 on the ground that they have purchased the property from defendant during the pendency of the suit.

From perusal of the impugned order, it appears that the registered sale deed was produced by the purchasers in the court below.

In view of the decision of the Supreme Court, A.I.R. 2005 Supreme Court 2209 the learned court below has rightly allowed the intervention application because the interveners are purchasers during the pendency of the suit. Therefore, I find no

Patna High Court CWJC No.5907 of 2016 (2) dt.26-07-2016 reason to interfere with the impugned order in exercise of supervisory jurisdiction.

Accordingly, this writ application is dismissed. (Mungeshwar Sahoo, J) Harish/- U
