2. Petitioner seeks pre-arrest bail in connection with Awtar Nagar P.S.Case no.189 of 2020, registered for the offences punishable under Sections 341, 323, 324, 308, 379, 504 and 506/34 of the Indian Penal Code.
3. As per the allegation made in the FIR, the petitioner has allegedly assaulted the nephew of the informant and snatched Rs.3,000/- from the informant.
4. Considering the nature of allegation made in the FIR, as well as, having perused the information contained in the impugned order dated 24.05.2024, I find that in view of the nature of allegation, the only point for consideration of granting
Patna High Court CR. MISC. No.55189 of 2025(2) dt.27-08-2025 2/2 bail to the petitioner would be whether the injury is grievous or simple in nature.
5. In view of the fact that the opinion of the Doctor has been kept reserved, the matter is remitted back to the learned district court concerned to re-hear without being prejudiced by his order dated 24.05.2024.
6. Let a copy of this order be communicated to the learned district court forthwith.
7. With the above observation/direction, the present bail application stands dispose of.
