Petitioner is named in the first information report but only suspicion has been raised against him.

During course of investigation, some witnesses stated that they had seen the petitioner as well as some other accused in the company of the deceased prior to alleged occurrence and except the aforesaid material, there appears to be nothing against the petitioner. Moreover, it is submitted that petitioner has been implicated in this case because he was witness against the informant of this case in a criminal case and having similar allegation some co-accused persons have already been granted privilege of bail. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
