JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 376, 323 and 504/34 of the Indian Penal Code.
It is alleged that while the informant went to collect firewood, Robin Yadav along with the petitioners and Amit Kumar came when Robin Yadav established forceful physical relationship with the informant.
It is submitted by learned counsel for the petitioner that the thrust of accusation is against Robin Yadav. The medical report completely negates the accusation of rape. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.2309 of 2015 (2) dt.20-01-2015 2/2 petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai in connection with Ballia P.S. Case No. 192 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
