Petitioner, already in custody, seeks bail in connection with Ratanpura P.S. Case No.53 of 2017, corresponding to Special Case No.16 of 2017, registered under Sections 20(b) and 22(b) of the NDPS Act.
Accusation is that petitioner was found selling Ganja in puriyas, when his house was searched, 5 Kgs. of Ganja was recovered.
Learned counsel for the petitioner submits that there is no recovery of Ganja from his house and the petitioner has been in custody in this case since 28.11.2017 and the petitioner has no criminal antecedent; whereas the learned counsel for the State submits that the seizure list clearly indicates the recovery
Patna High Court Cr.Misc. No.29886 of 2018(4) dt.02-08-2018 2/2 from the house of the petitioner and there is also signature regarding acceptance of the copy of the same. Having considered the aforesaid facts and circumstances, as the charge has been framed and the evidence is being recorded by the trial court, so the prayer of bail of the petitioner is rejected.
However, the trial court is directed to expedite the trial and preferably conclude the same within six months. If the trial is not concluded within the stipulated period, the petitioner may renew his prayer of bail. (Arun Kumar, J) S.KUMAR/- U T
