This is a petition for grant of anticipatory bail for offence under Section 47(a) of the Bihar Excise Act. Thirty liters of country made liquor was allegedly recovered from the shop of this petitioner on 03.02.2016. Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail.

The prayer for anticipatory bail is refused.

However, in the event of surrender of the petitioner, his prayer for regular bail shall be disposed of without being prejudiced of this order and also considering the fact that under the old Act the punishment was lesser than the new Act.
