The petitioner apprehends his arrest in Kotwali P.S. Case No. 288 of 2014, registered for the offences punishable under Sections 419, 420 and 34 of the Indian Penal Code and Section 10 of Bihar Examination Board Act, 1981. According to the prosecution allegation during the course of examination Gautam Kumar was found appearing in place of the petitioner. Lalit Kumar was appearing in place of Akash Kumar Singh and Saroj Kumar was appearing on behalf of Md. Jaid. All the four persons were arrested. Learned counsel for the petitioner submits that the petitioner is a student and he has got no criminal antecedent. It appears that the petitioner set up Gautam Kumar to

Patna High Court Cr.Misc. No.5207 of 2015 (2) dt.06-02-2015 appear at the written examination for appointment of constable. Gautam Kumar was apprehended and from his possession the admit card of the petitioner was recovered.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
