JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 386/34 of the Indian Penal Code.

It is obvious from perusal of the first information report that it was co-accused Manjesh Yadav, who happens to be full brother of the petitioner, demanded extortion money. Although, it is stated that this petitioner and one Dumriwali accepted the extortion money from the informant but submission on behalf of the petitioner is that co-accused, Manjesh Kumar Yadav @ Manjesh Yadav has already been granted privilege of bail by a co-ordinate Bench of this Court.

Patna High Court Cr.Misc. No.15698 of 2016 (2) dt.19-04-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Begusarai in connection with Dandari P.S. Case No. 61 of 2015.
