JUSTICE SUDHIR SINGH ORAL ORDER 30-04-2015 The petitioners are apprehending their arrest in connection with Mirganj P.S.Case No. 262 of 2014 instituted under Sections 323, 380, 429, 457 and 504 of the Indian Penal Code.

Heard learned counsel for the petitioners and the State. The prosecution story, in brief, is that on 5.8. 2014 the accused persons came to the door of the complainant armed with country made pistol and bomb. The accused persons forcibly opened the door and asked the family members to keep quite. They opened a box , kept in the house, and took away Rs. 40,000/- in cash and ornaments of rupees two lacs. In the meantime, the complainant came and raised alarm. The accused persons after throwing bomb fled away.

No.49716 of 2014 (2) dt.30-04-2015 2/2 It is submitted on behalf of the petitioners that the complainant and the petitioners are of the same family and the present prosecution has been brought due to land dispute. It is also submitted that petitioner no.1 had filed an informatory petition in the court of learned C.J.M., Gopalganj prior to the institution of the present case. The same is Annexure 2 to the present application.

On behalf of the State it is submitted that the petitioners are named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand)each with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj, in connection with Mirganj P.S.Case No. 262 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C. (Sudhir Singh, J) singh/- U
