2. The ground being urged by the counsel for the appellant is that he decided to move the High Court after a similarly situated person was granted leave in terms of Annexure-6 to the memo of appeal. Annexure-6 was passed on 12.02.2004 whereas the writ was filed at the end of 2007 challenging dismissal of the year 1999. That was the reason why the learned Single Judge dismissed the

Patna High Court LPA No.1403 of 2013 dt.17-02-2017 2 / 2 writ application refusing to entertain the writ in his discretion. He has committed no infirmity by doing so.

3. Appeal has no merit. It is dismissed.
