JUSTICE ARUN KUMAR ORAL ORDER 18-05-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Sour Bazar P.S.Case No. 363 of 2017 registered under Sections 363 and 365 of the Indian penal Code. Allegation in brief is that informant's wife with two children is found missing from the house and it is alleged that petitioner, who had illicit affair with his wife, had abducted her along with his children.
Submission is that petitioner is agnate and happens to be the nephew in relationship of the lady. It is alleged that she was brought to Rajasthan but petitioner was apprehended from the village itself and no investigation has been done with respect to from whose mobile call was being made to the informant and
Patna High Court Cr.Misc. No.16278 of 2018(4) dt.18-05-2018 2/2 the informant's wife along with children are still traceless and petitioner is in custody since 12.10.2017 having no criminal antecedent.
Having considered the aforesaid facts and circumstances, the petitioner, namely , Ankit Kumar @ Ankit Kumar Singh, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Saharsa in connection with Sour Bazar P.S. Case No. 363 of 2017.
