The petitioner is apprehending his arrest in a case registered under Section 138 of the N.I. Act and Section 406 of the Indian Penal Code.
The complainant alleged that the petitioner had taken a loan of Rs. 3,75,000/-, but on demand, he handed over three cheques. When the cheques were presented, they were dishonoured.
Learned counsel for the petitioner submits that the petitioner is ready to pay the entire loan amount of Rs. 3,75,000/- within four months in equal installments.
Considering the facts aforesaid, if the petitioner deposits rupees One lakh, in the event of his arrest or surrender
Patna High Court Cr.Misc. No.2956 of 2015 (2) dt.21-01-2015 2/2 before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, let the petitioner named above be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Anupam Kumari, Judicial Magistrate 1st Class, Muzaffarpur in Complaint Case No. C3167/12, Tr. No. 3948/14, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, with a further condition that the petitioner shall deposit rest of the loan amount of Rs. 2,75,000/- in three installments, each of Rs. 1,00,000/-, Rs. 1,00,000/- and Rs. 75,000/- in the subsequent three months. If the petitioner fails to deposit any installment, his bail bonds shall be cancelled.
