The petitioner is in custody since 09.07.2019 in connection with Kanhauli P.S. Case No. 88/17 registered for the offence punishable under Sections 273 of the Indian Penal Code and Section 30 A of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the recovery has been made from the bag and not from the conscious possession of the petitioner.
