Mr.Shailendra Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-11-2019 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are languishing in custody since 12.06.2019 in a case registered for the offences punishable under Sections 420, 467, 468, 469, 406, 120B/34 of the Indian Penal Code.

The prosecution case is that the FIR named accused persons including the petitioners collected Rs.9,60,000/- from the informant and Raju Sahni for getting them employment in Civil Court, Patna. It is alleged that the money was transferred in the account of the petitioners.

Patna High Court CR. MISC. No.54894 of 2019(4) dt.20-11-2019 2/2 Learned counsel for the informant and State after going through the case diary submit that though accusation is that the money was transferred in the bank account of the petitioners but the I.O. has not verified the bank account of the petitioners whether the money has been transferred or not. A statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent.

Considering the fact the person wanted to get employment through illegal means has to suffer at the hands of the fraudulent persons coupled with the statement made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Bramhpur (Nainijor) P.S. Case No. 258 of 2019.
