The petitioner apprehends his arrest in a case registered for the offence under Section 5, 9, 10, 13 of Bihar Wood Saw Act and Section 41, 42 of Indian Forest Act. As per the prosecution case, the petitioner was running saw mill illegally.

It is submitted on behalf of petitioner that entire allegation is false and concocted. Seizure was not prepared in accordance with law and seized articles are mango trees, which do not come under the definition of the forest produce. it is next submitted that petitioner had no knowledge of institution of case and he came to know only when he received a notice through Lok Adalat. Petitioner has got clean antecedent.

Considering the aforesaid facts and circumstances, the prayer for anticipatory bail is rejected.
