The petitioner seeks bail in Waris Nagar P.S. Case No. 178 of 2016 registered for the offence punishable under Sections 302, 307/34 of the Indian Penal Code. Informant in his written report has alleged that while his wife, Daughter-in-Law and the daughter of his co-brother were coming back home after distributing 'prasad' in the neighbourhood on the occasion of the engagement ceremony of his son, some unknown persons fired at them, leading to injuries to his wife and Daughter-in-Law, both of whom later succumbed to such injuries. The daughter of his co-brother remained unhurt.

It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.33497 of 2018(3) dt.14-08-2018 2/2 he is innocent and has been falsely implicated in this case due to village politics. It has been further submitted that petitioner is not named in the FIR and nothing has been specifically alleged against the petitioner and he has been implicated in this case on mere suspicion. Similarly, situated co-accused person has been granted bail by a co-ordinate bench of this Court vide order dated 18.05.2018 passed in Criminal Miscellaneous No. 26020 of 2018. Petitioner is in custody since 19.01.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Waris Nagar P.S. Case No. 178 of 2016.
