Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Bakhtiyarpur Police Station Case No. 59 of 2020, for the offences under Sections 341, 323, 326, 504, 354(A), 379/34 of the Indian Penal Code.
As per allegation, two brothers of the informant namely Shiv Kumar Ram and Dharmendra Ram were making a
Patna High Court CR. MISC. No.67832 of 2021(2) dt.02-06-2022 2/3 chamber at the main door of the house. The informant protested, thereupon both co-accused badly assaulted him. The allegation against petitioner no. 1 and 2 is that they assaulted the wife of the informant.
Learned counsel for the petitioners have submitted that both the parties belong to the same family and some dispute arose between them in respect of the construction of the chamber. Petitioner no. 3 is father of the informant and petitioner no. 1 and 2 are Bhabhi and nephew of the informant. There is allegation against petitioner no. 1 & 2 to assault the wife of the informant, but she has not sustained any injury. All the petitioners are the persons of clean antecedents. Considering the above mentioned facts and circumstances, the petitioners above named, in the event of their arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IIIrd, Barh, Patna, in connection with Bakhtiyarpur Police Station Case No. 59 of 2020, subject to condition as laid down under section 438(2) Cr.P.C.
Office shall ensure that all defects are removed by the
Patna High Court CR. MISC. No.67832 of 2021(2) dt.02-06-2022 3/3 petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
