The petitioner has prayed for bail in a case registered for the offence punishable under sections 399 and 402 of the Indian Penal Code and sections 25(1-b)a, 26, 35 of the Arms Act.

As per allegation in the FIR, on getting secret information, patrolling party proceeded towards place of occurrence, and on seeing them all the five accused persons started to fleeing away. On chase, out of them four persons were apprehended including the petitioner. On search, several arms were recovered from other co-accused persons and from the petitioner, one country made pistol one android phone were recovered.

He is innocent and has committed no offence. By using pressure, police took his signature on plain paper and manufactured the same as the seizure list. Petitioner is languishing in judicial custody since 21.04.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Madhepura in connection with Singheshwar P.S. Case No. 91 of 2022.
