JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 Heard learned counsel for the petitioner and the State. The petitioner is languishing in custody since 10/10/2014 in a case registered for the offences punishable under Sections 147, 148, 149, 504, 323, 324, 307, 337 and 448 of the Indian penal Code.

It is alleged that seven persons came and assaulted the informant with lathies. The petitioner is alleged to have assaulted with sickle on the head and hand of the informant. When the informant's wife came to rescue then all accused persons assaulted her.

It is submitted that for the occurrence of 23/09/2012 the FIR was lodged on 25/09/2012. There is counter version of the occurrence also. There is no injury report of the informant on the

Patna High Court Cr.Misc. No.2668 of 2015 (2) dt.22-01-2015 2/2 record. The injury of the wife of the informant has been found simple in nature. The petitioner has no criminal antecedent. Statement to that effect has been made in para 3 of the petition. Considering the delayed lodging of the FIR, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani in Sakari P.S.Case no.146 of 2012.
