JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-02-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Musrigharari Police Station Case No. 78 of 2016, disclosing offences under Sections 302/34 of the Indian Penal Code.
Learned counsel for the petitioners has submitted that these petitioners, being father-in-law and mother-in-law of the deceased, have falsely been implication in this case on the ground of suspicion. No specific case is made out against these petitioners for the alleged occurrence. These petitioners have no concern with the personal affairs of husband and wife-deceased. Moreover, a compromise arrived at between the both parties,
Patna High Court Cr.Misc. No.1817 of 2017 (4) dt.21-02-2017 which is evident from Annexure-2. Hence, the petitioners deserve the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Samastipur in connection with Musrigharari Police Station Case No. 78 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
