Mr. Md. Ashlam Ansari ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 30-05-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Hajipur Sadar P.S. Case No. 552 of 2017, registered for the offence punishable under Sections 399/402/414 of the Indian Penal Code and Sections 25(1-B)a/26/35 of the Arms Act. The allegation is regarding the petitioner and another co-accused persons having been apprehended and as far as the petitioner is concerned, four live cartridges are said to have been recovered from his possession.

The learned counsel for the petitioner submits that the petitioner is innocent and he is having a clean antecedent. It is further submitted that the similarly situated co-accused person has already been granted bail by this Court by an

Patna High Court Cr.Misc. No.12715 of 2018(4) dt.30-05-2018 2/2 order dated 08.03.2018 passed in Criminal Miscellaneous No. 13688 of 2018. The petitioner is stated to be languishing in custody since 08.11.2017.

Having regard to the facts and circumstances of the case and also the fact that similarly situated co-accused person has been allowed bail by this Court, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 552 of 2017.
