The petitioner, who is in custody, seeks bail in connection with Sanokhar (Amdanda) P.S. Case No. 125 of 2017 registered for the offence punishable under Sections 304(B) of the Indian Penal Code and 3 and 4 of the Dowry Act. Informant is the brother of deceased, who in his written complaint has stated that the marriage of his sister Chhoti Devi was solemnized with petitioner. In the FIR the informant has alleged committing murder of her sister by strangulation against four named persons. Petitioner is not named in the FIR. Allegation against the petitioner is only demand of dowry.
Patna High Court Cr.Misc. No.34935 of 2018(4) dt.16-08-2018 2/2 It has been submitted that petitioner was not present at the place of occurrence and he was outside the State to earn his livelihood. It has been further submitted that the deceased has committed suicide and the family member and in-laws were informed about the death of deceased. In the postmortem report also death is attributed to Asphyxia caused due to hanging. Petitioner has no criminal antecedent and he is in custody since 06.01.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-IV, Bhagalpur, in connection with Sanokhar (Amdanda) P.S. Case No. 125 of 2017.
