JUSTICE SANJAY PRIYA ORAL ORDER 09-02-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in Agion (G) P.S. Case No.79 of 2016 instituted for the offence under Sections 341, 342, 324, 326, 307 and 498A/34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code has also been added as well as Section 3/4 of the Dowry Prohibition Act. It has been submitted that the husband is already in custody. There is specific allegation of causing burn injury to the deceased on the husband.

As per the fardbeyan of the deceased, she was married with Arun Singh. She was tortured by her husband and other family members for demand of Rs.1 lac. It is alleged that on

Patna High Court Cr.Misc. No.3570 of 2017 (2) dt.09-02-2017 20.08.2016 at 7.00 pm she was assaulted by her husband and other family members. It is further alleged that her husband burnt her after pouring kerosene oil. She raised alarm to save, but nobody came to save her. She was taken to private hospital for treatment. The information of the occurrence was given to her family members and they have arrived in the hospital. These petitioners are said to be father-in-law and mother-in-law of the deceased. As per written report itself it appears that there is general and omnibus allegation against them. There is specific allegation against the husband, who is already in custody. Therefore, prayer of the petitioners for anticipatory bail is allowed.

In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Agion (G) P.S. Case No.79 of 2016, they shall be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VII, Bhojpur at Ara, subject to the conditions as laid down under Section 438(2) Cr.P.C.
