Petitioner, who is in custody, seeks bail in connection with Khagaria (Mahila) P.S. Case No. 19 of 2018 registered for the offence punishable under Section 376 of the Indian Penal Code and Section 67 of the Information Technology Act.

Informant Sarita Devi, in her written complaint has stated that petitioner and other co-accused persons have established illicit relation with her and are thereafter sharing objectionable pictures and video among their friends on whatsApp.

According to FIR and re-statement of informant Sarita Devi is married woman having three children. It has further been submitted that similarly placed co-accused, namely, Mohan Sah, Raju Sah and Mukesh Kumar Sah, have already been granted anticipatory bail by the court below. He has no criminal antecedent and is in custody since 10.05.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Class J.M., Khagaria, in connection with Khagaria (Mahila) P.S. Case No. 19 of 2018.
