JUSTICE SANJAY KUMAR ORAL ORDER 07-06-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners, who are in custody since 03.03.2018, seek bail in connection with Special Case No. 1925/2018 arising out of Kotwali P.S. Case No. 124/2018 registered for the offences punishable under sections 272 and 273/34 of the Indian Penal Code and 30(a), (c), (d), 34(b) of the Bihar Prohibition and Excise Act, 2016.

The informant happens to be a Police Officer who, on secret information on the occasion of Holi festival, visited at the place of the petitioner and found the petitioner indulged in selling the intoxicated material and seized hemp and its powder, etc.

Patna High Court Cr.Misc. No.29676 of 2018 (4) dt.07-06-2018 2/2 which have been mentioned in the seizure list. It has been submitted that the petitioner has clean antecedent and has falsely been implicated in the present case. Considering the facts and circumstances of the case, the prayer for bail of the petitioners is allowed and they are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna in connection with Special Case No. 1925/2018 arising out of Kotwali P.S. Case No.124/2018, subject to the following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioners will not induce any witness or tamper with the evidence.

(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
