Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-307, 379 & other minor sections of the Indian Penal Code.
Petitioner is said to have fired causing fire-arm injury to the injured, Mohit Rai but submission on behalf of the petitioner is that the alleged occurrence appears to have taken place on account of land dispute and both the parties lodged cases
Patna High Court Cr.Misc. No.15993 of 2016 (2) dt.21-04-2016 2/2 against each others. It is further submitted that moreover, the injured Mohit Rai sustained simple injuries though said to be caused by fire-arms and moreover, having more or less similar allegation, co-accused Ram Naresh Rai and Rameshwar Rai have already been granted privilege of bail by a coordinate bench of this court.
Considering the above-said submission as well as facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Rajepur P.S. Case No. 19 of 2010 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sadar, Motihari, East Champaran.
