JUSTICE SUDHIR SINGH ORAL ORDER 30-04-2015 The petitioners are apprehending his arrest in connection with Kurtha P.S.Case No. 68/2006 instituted under Sections 455, 353 and 426/34 of the Indian Penal Code.
Heard learned counsel for the petitioners and the State. The prosecution story, in brief, is that the informant is Junior Engineer of Electric Supply Branch, Kurtha, who has alleged that while the informant along with his official were realizing electric bill, in the meantime, under the leadership of these two petitioners, the civic of Kurtha market had started abusing with slogan not to pay the bill against not availability of electric and they have forcibly entered into his office and damaged the chair and table.
It is submitted on behalf of the petitioners that in course
Patna High Court Cr.Misc. No.49729 of 2014 (2) dt.30-04-2015 2/2 of investigation the police found the case to be false and submitted final form in the court below, which is Annexure-2 to the application.
On behalf of the State, it has been submitted that there is specific allegation against the petitioner and further It has been submitted that the court below after differing from the final form has taken cognizance in the present case.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri B.M. Tripathi, Judicial Magistrate, 1st Class, Jehanabad in Trial No. 448 of 2014 arising out of Kurtha P.S.Case No. 68/2006, subject to the conditions as laid down u/s 438(2) Cr.P.C.
