This application is for grant of regular bail in connection with Minapru P.S.Case no.68 of 2018 dated 21.2.2018, G.R.No.852 of 2018 for the offences under Sections 414/34 of the Indian Penal Code and 25(1-B)A/26/35 of the Arms Act . Allegation against the petitioner is that there is allegation about recovery of one country-made pistol and submission of the learned counsel for the petitioner is that he is in custody for more than seven month, though he has been made accused in six other cases, in four cases he has been acquitted. Heard learned A.P.P. and from perusal of the record it appears that no details of the cases wherein the petitioner is accused, have been mentioned either in the petition or in the
Patna High Court Cr.Misc. No.44082 of 2018 (4) dt.01-10-2018 2/2 supplementary affidavit.
IN such view of the matter, I am not inclined to grant bail to the petitioner, however, this application is disposed of with direction to the learned C.J.M. to verify the criminal antecedent of the petitioner and if it is found true that he is accused in six other cases and in four cases he has been acquitted, he shall be released on bail in connection with Minapur P.S.Case No.68 of 2018 (g.R.No.852 of 2018) to the satisfaction of C.J.M., Muzaffarpur. With the aforesaid observation, this application is disposed of.
