JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 466, 467, 473, 474, 484/34 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Prosecution case is that the informant's husband Bharat Sah, agreed to purchase a piece of land, appertaining to Khata No. 298, Plot No.253, from one Rameshwar Singh. The sale deed was executed and registered on 01.08.2013. The petitioner was the deed writer but receipt was not given to the husband of the informant. Subsequently, the certified copy of the sale deed was obtained when it was found that the sale deed was executed with regard to land appertaining to Khata No.70, Plot No. 486 in stead of Khata No. 298, Plot

It is submitted by learned counsel for the petitioner that the thrust of accusation is against Rameshwar Singh. The FIR has been lodged with inordinate delay.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saran at Chapra in connection with Ekma P.S. Case No.17/2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
