Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State as also learned counsel, appearing for the informant.

Petitioners apprehend their arrest in connection with

Patna High Court Cr.Misc. No.3112 of 2015 (2) dt.22-01-2015 2/3 Munger Muffasil P.S. Case No. 65 of 2014 registered for the offences punishable under Section-376 & other minor sections of the Indian Penal Code.

According to prosecution case itself, it was co-accused, Chandan Kumar and Dashrath who committed rape upon the informant and so far as petitioners are concerned; it is stated that petitioner No. 2 took the informant to her home where the occurrence of rape occurred and so far as the petitioner No. 1 is concerned; it is stated that he made firing upon the informant as well as her brother but admittedly, none sustained fire-arm injury. It would appear from perusal of the impugned order of learned Sessions Judge that in course of investigation, some witnesses stated that the informant had love affairs with coaccused, Dashrath Kumar.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.
