JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406,419,420 and 120B of the Indian Penal Code.
The accusation is of taking pass-book and ATM card of the informant and misusing the same.
It is submitted by learned counsel for the petitioner that there is no proof of giving ATM Cards or pass book to the petitioner. It is further submitted that the informant's ATM Card was misused for which police of Dausa P.S. of the State of Rajasthan came to make enquiry and, thereafter, in order to save his own skin, the informant lodged the present case. Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.2778 of 2015 (2) dt.21-01-2015 2/2 petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Jagdishpur P.S. Case No. 208 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
The bail bonds of the petitioner will be accepted on filing of an affidavit by the petitioner before the learned court below that he will regularly cooperate with the investigation. The said affidavit will be transmitted by the learned court below to the concerned I.O. Non cooperation in investigation by the petitioner will give liberty to prosecution to file application for cancellation of bail bond of the petitioner by learned court below.
