The petitioner seeks bail in Ara Muffasil P.S. Case No. 183 of 2020, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, on 15.06.2020 at about 11.00 am informant's father went to the clinic of co-accused Pintu with Rs. One lakh for purchasing a piece of land. When his father did not return, informant went to the clinic of coaccused Pintu, but he did not find his father. On the next day, in the morning, dead body of informant's father lying by the side of road. Informant suspects that co-accused Pintu killed his father for grabbing his money.

It is submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.67277 of 2021(2) dt.28-02-2022 2/2 informant is not eye-witness of the occurrence. Petitioner has been made accused in this case on the basis of confessional statement of co-accused Pintu who has already been granted bail by this Court vide order dated 23.03.2021 passed in Cr. Misc. No. 4412 of 2021. Save and except confession of co-accused there is no material against this petitioner. Petitioner claims clean antecedent and he is in custody since 16.08.2021. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Muffasil P.S. Case No. 183 of 2020.
