The petitioners are apprehending their arrest in connection with Complaint Case No. 37 C/ 2014 for the offence
Patna High Court Cr.Misc. No.49966 of 2014 (2) dt.08-05-2015 2/3 under Sections 498A, 504 and 494 of the Indian Penal Code and Section 3 /4 of D.P.Act.
Heard learned counsel for the petitioners and the State. The allegation against the petitioners is demand of dowry and torture.
It has been submitted on behalf of the petitioners in Cr. Misc. No. 49925/2014 that they are father-in-law and mother-inlaw and petitioner in Cr. Misc. No.4996/2014 is concerned, he is the brother-in-law of the complainant. Further it has been submitted that the petitioners have no concern with the husband of the complainant nor they are involved in their affairs. Further my attention has been drawn to Annexure 2 to the present application where an application u/s 9 of Hindu Marriage Act has been preferred by the husband of the complainant. Further it has been pointed out that Matrimonial Divorce Case No.46/2013 has also been preferred by the husband of the complainant under Section 13( i) of the Hindu Marriage Act.
On behalf of the State, it has been submitted that that the petitioners are named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on
Patna High Court Cr.Misc. No.49966 of 2014 (2) dt.08-05-2015 3/3 furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Saharsa in connection with Complaint Case No. 37 C/ 2014 , subject to the conditions as laid down u/s 438(2) Cr.P.C.
