The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 308, 379, 337 and 504 of the Indian Penal Code. It is a case of assault due to which the informant sustained injuries.

It is submitted by learned counsel for the petitioners

Patna High Court CR. MISC. No.66824 of 2021(2) dt.18-07-2022 2/2 that the petitioners have falsely been implicated in this case. He further submits that there is case and counter case between the parties and both parties have sustained injuries as alleged in separate incident. Specific allegation of assault is against coaccused Shailendra Yadav by means of iron rod on the head of the informant and not these petitioners in the present case. Petitioners have got clean antecedent.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Miss Priya Shekhar, Judicial Magistrate, Ist Class, Gaya in connection with Nimchak Bathani P.S. Case No. 83 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U
