The petitioner apprehends his arrest in Halsi P.S. Case No. 165 of 2015, registered for the offence punishable under Section 379 of the Indian Penal Code and under Section 7 of the E.C. Act.
The informant Block Development Officer, Ramgarh intercepted Thela upon which rice was being carried. Amit Paswan was driving the Thela he did not disclose name of any person.
It is submitted that, in fact, nobody has seen the petitioner giving rice to the Thela puller. Similarly situated coaccused Mantoo Sao has already been granted anticipatory bail vide orders passed in Cr. Misc. No. 4513 of 2016 on 02.02.2016
Patna High Court Cr.Misc. No.16076 of 2016 (2) dt.06-05-2016 2/2 by a coordinate Bench of this Court.
Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in Lakhisarai P.S. Case No. 165 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
