The petitioner apprehends his arrest in connection with Ara Nawada P.S. Case No.74 of 2019, giving rise to Sessions Trial No.130 of 2022, registered for the offences punishable under Sections 302/34 of the Indian Penal Code. The petitioner and other co-accused persons are said to have shot dead the son of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is submitted that after investigation, the police submitted final form against the petitioner, but during trial some witnesses have been examined and they have taken the name of

Patna High Court CR. MISC. No.55645 of 2022(2) dt.20-12-2022 2/2 the petitioner and on that basis the petitioner was summoned by the trial court under Section 319 Cr.P.C.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Considering the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, XIII, Bhojpur at Ara in connection with Ara Nawada P.S. Case No.74 of 2019, giving rise to Sessions Trial No.130 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
