The petitioner apprehends his arrest in connection with Parbatta P.S. Case No. 68 of 2016, registered under Sections 341, 323, 398(A), 494 and 506 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The accusation is of torturing the informant by her husband and in-law due to non-fulfillment of demand of dowry and also keeping another girl by this petitioner, husband of complainant.
Learned counsel for the petitioner submits that petitioner is the husband of the informant and he has falsely been
Patna High Court Cr.Misc. No.1897 of 2017 (3) dt.18-04-2017 implicated in this case due to misunderstanding and the informant is still residing at the house of the petitioner. It is further submitted that while notice has been received by the opposite party no. 2 but she has not appeared in the court.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Khagaria, in connection with Parbatta P.S. Case No. 68 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
