JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-10-2018 The petitioner is in custody since 23.12.2017 in connection with Bihar Sharif Rail P.S. Case No. 16 of 2017, registered for offences punishable under Sections 395 and 307 of the Indian Penal Code.

Allegation as per F.I.R. is that some miscreants have pulled the chain of the train and stopped the train and thereafter committed lootpat in the train. Petitioner is not named in the F.I.R. Submission of learned counsel for the petitioner is that the petitioner has been made accused in this case only on confessional statement of co-accused and from the CDR location. Further submission is that one of the co-accused persons having similar allegation has already been granted bail by a Coordinate Bench of this Court vide order dated 27.09.2018 passed in Cr.

Patna High Court Cr.Misc. No.44055 of 2018 (4) dt.03-10-2018 2/2 Misc. No.47909 of 2018.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances as stated above, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Railway, Patna, in connection with Bihar Sharif Rail P.S. Case No. 16 of 2017, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

It is made clear that if the petitioner again found involved in such type of offence in future, the prosecution will be at liberty to move for cancel of his bail bond. (Vinod Kumar Sinha, J) sunil/Amjad/- U T
