JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420/34 of the Indian Penal Code.
The prosecution case is that at the B. Com examination one Sunil Kumar was appearing in place of the petitioner. It is submitted by learned counsel for the petitioner that the petitioner was not named in the FIR and chargesheet has been submitted in the matter on 29.02.2016. Even assuming the accusation, the offence is made out under Section 419 of the IPC. It is further submitted that the petitioner was not aware about Sunil Kumar appearing at the examination in his place and non-grant of bail to the petitioner will jeopardize the career of the petitioner.
