Learned counsel for the petitioners submits that police after investigation submitted charge sheet under bailable Sections of the Indian Penal Code and asked the petitioner under Section 41 Cr.P.C. to appear in court, but the Chief Judicial Magistrate, Araria took cognizance under Section 307 of the Indian Penal Code.
Learned counsel for the petitioners seeks permission to withdraw this anticipatory bail petition.
Patna High Court Cr.Misc. No.8019 of 2017 (3) dt.16-03-2017 2/2 Prayer is allowed.
The anticipatory bail petition is disposed of as withdrawn.
If the petitioners surrender in the court below the court below shall take into consideration that on account of assault made by the petitioners there is simple injury except one on the body of the injured, even the grievous injury was found on the elbow of the hand and similarly situated co-accused has already been granted regular bail and dispose of the bail petition preferably on the same day.
