The petitioners apprehend their arrest in Sugali P.S. Case No.246 of 2016 registered for the offences punishable under Sections 420, 467, 468, 493, 406, 384, 504 and 120B of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act. As per the allegation disclosed in the FIR, allegation against the petitioners is that Rs.5,00,000/- was given to the petitioners by the informant for the purposes of marriage of his daughter one year prior to the date of marriage and thereafter petitioner no.2 refused to marry with his son and except that there

Heard learned A.P.P. and learned counsel for the informant. They have opposed the prayer for bail and submit that the petitioners have cheated the informant by grabbing Rs.5,00,000/-.
Having heard both sides. In view of the facts as stated above and considering the nature of allegation, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sadar, Motihari (East Champaran) in connection with Sugaili P.S. Case No.246 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
(i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
(ii) The petitioners shall cooperate in the investigation and make themselves available as and when required by the police and on the event of failure on their part to appear before the police on two consecutive dates without showing any
