The petitioner apprehends his arrest in a case registered for the offence under Sections 420, 467, 468, 471 of the Indian Penal Code and Sections 30(a), 32(i)(ii)(iii), 36, 41(i) (ii) of Bihar Prohibition and Excise Act.

Total 3663 liters of illicit foreign liquor has been recovered from different vehicles.

It is submitted on behalf of petitioner that petitioner is neither owner nor driver of any of the vehicles in question and has got no concern with the alleged recovery. Nothing has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.

Considering the nature of allegation and clean
