The petitioner apprehends his arrest in Ekma P.S. Case No. 172/2015, registered for the offence punishable under Sections 304B, 201, 34 of the Indian Penal Code. The informant alleged that he married his daughter with the petitioner, but petitioner and in-laws started demanding dowry and also subjected her to all sorts of torture. The petitioner also filed divorce case no. 225/13 in the family court Chapra in which compromise was arrived at between them and the petitioner took his wife and his daughter to his own house, but within four months he killed his wife.

Mr. Nawal Kishore Singh learned counsel for the petitioner submits that wife of the petitioner was ill and she died

It appears that witnesses have very categorically stated that petitioner firstly filed divorce case in which compromise was arrived at between husband and wife and thereafter he took his wife and daughter to his own house, but within four months petitioner killed his wife and cremated her dead body. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
