The petitioner apprehends his arrest in Turkauliya P.S. case No. 500 of 2016 under Section 307, 395 and other Sections of the Indian Penal Code.
The informant, Junior Engineer, on the basis of statement of Chowkidar named 63 persons.
It is submitted that petitioner is named in the FIR but no specific allegation is made against the petitioner. The petitioner is elected Mukhiya of the Panchayat and Durga Puja was organized but the police wanted that the procession should not be taken out and that is why visitors raised slogans. It is submitted that three cases, i.e. Turkauliya P.S. case No. 496 of 2016,
Patna High Court Cr.Misc. No.1500 of 2017 (2) dt.17-01-2017 2/2 Turkauliya P.S. case No. 499 of 2016 and the present Turkauliya P.S. case No. 500 of 2016 were lodged against Hindu community. Two cases were also lodged against Muslim community. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in Turkauliya P.S. Case No. 500 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
